Terms of Service

1. Acceptance of Terms

By accessing or using the PEAK app, website, or related services (the "Service"), you agree to be bound by these Terms of Service and any additional rules or policies that apply to specific features. If you do not agree, do not use the Service.

2. Description of the Service

PEAK is a fantasy sports application that includes features such as account creation, league management, player drafts, fantasy team management, standings, leaderboards, scoring, and playoff-related competition. Features may change over time, and some features may be experimental or limited in certain versions of the app.

3. Eligibility

You must be at least 13 years old to use PEAK. By using the Service, you represent that you meet this requirement and that you are legally able to enter into a binding agreement. If PEAK introduces features that require a higher minimum age in certain jurisdictions, those requirements will be noted at the time of introduction.

4. User Accounts

To access many features, you must create an account. You agree to:

• Provide accurate and current registration information
• Maintain the security and confidentiality of your account credentials
• Promptly update any inaccurate account information
• Accept responsibility for all activity that occurs under your account
• Not share your account or credentials in a way that compromises account security or violates these Terms

5. League and Gameplay Rules

PEAK offers different league settings, draft formats, scoring systems, and commissioner tools. By participating in leagues and drafts, you agree that:

• Gameplay results depend on the rules, settings, and data available through the Service at the time of play
• Commissioners have limited control over league configuration and membership; PEAK is not responsible for commissioner decisions, league management disputes, or actions taken by commissioners within their leagues
• Displayed rankings, projections, and fantasy scoring are informational features and not guarantees of accuracy or completeness
• PEAK may correct obvious product or data errors when reasonably necessary to preserve service integrity, including adjusting scoring where an underlying sports data error is identified
• Fantasy scoring data may be subject to delays or corrections based on third-party sports data availability; PEAK is not liable for such delays or errors

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful, fraudulent, or abusive purpose
• Attempt to gain unauthorized access to accounts, systems, or data
• Circumvent any security, authentication, or access controls
• Use automated tools, bots, or scripts to access the Service in a way that burdens or harms its operation
• Scrape, harvest, or collect user data without authorization
• Harass, abuse, threaten, or harm other users
• Post false, misleading, or deceptive content
• Impersonate another person or misrepresent your affiliation with any entity
• Upload or transmit harmful, infringing, or unlawful content

7. No Real-Money Wagering

PEAK is a free-to-play fantasy sports application unless expressly stated otherwise in writing. PEAK is not a sportsbook, casino, or real-money wagering platform, and nothing in the Service should be construed as an offer of gambling, betting, or regulated gaming services. PEAK does not offer entry fees, cash prizes, or monetary rewards of any kind in its current form.

8. Intellectual Property

All content, trademarks, logos, software, and other materials associated with PEAK are the property of PEAK and its licensors, except for content that users lawfully submit and retain rights to. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, reproduce, modify, or distribute any part of the Service without our express written permission.

9. Third-Party Data and Sports Disclaimer

PEAK is an independent product and is not affiliated with, endorsed by, or sponsored by any professional basketball league, team, player association, or governing body. Fantasy scoring, player statistics, and game data may incorporate third-party sports data. We do not guarantee that this data will be complete, accurate, timely, or continuously available. Data outages, stat corrections, or delays may affect scoring results, and PEAK is not liable for outcomes resulting from such issues.

10. Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee uninterrupted availability or that all features will remain available in the same form.

11. Termination and Suspension

We may suspend or terminate your access to PEAK if we believe you have violated these Terms, your use creates security or legal risk, or we need to protect the Service or its users. You may stop using the Service at any time. Termination does not limit any other rights or remedies available to PEAK.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PEAK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14. Indemnification

You agree to defend, indemnify, and hold harmless PEAK and its operators, affiliates, licensors, and service providers from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: your use of the Service, your violation of these Terms, your violation of any third party's rights, or any content you submit through the Service.

15. Dispute Resolution

We encourage you to contact us first at support@peakfantasy.app to resolve any concerns informally. If a dispute cannot be resolved informally, it will be subject to the governing law and jurisdiction set out in Section 16.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to the personal jurisdiction and venue of those courts.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
